Hearings And Appeals
The Office of Hearings and Appeals (“Office”) is responsible for adjudicating disputes between individuals and other entities (e.g., partnerships, corporations) and the Department of Health and Social Services’ offices that administer departmental programs. The Office, upon the request of the Department, affected individual or entity, holds evidentiary hearings before impartial Hearing Officers who receive training at the National Judicial College. The Hearing Officers issue either final decisions or recommended decisions, depending upon the program involved. The decisions are ultimately appealable to the Superior Court. The Office, upon the request of all the parties involved, also provides mediation services on a case-by-case basis. These services are supplied in house by a Hearing Officer who is a certified mediator.
The Office decides disputes involving a wide range of issues and programs, including, but not limited to:

Public Assistance benefit program cases, also referred to as “Fair Hearings.” These hearings cover the broad range of public assistance programs administered by the Department: Food Stamps, Alaska Temporary Assistance (TANF), Adult Public Assistance, Child Care Assistance, the wide variety of Medicaid eligibility and coverage issues (pregnant women coverage, Denali KidCare, Health and Community Based Waiver, Personal Care Assistant, Chore Services, Care Management, Children’s coverage, etc.), CAMA (Catastrophic and Acute Medical Assistance), Senior Care, General Relief, and Heating Assistance.

Public Assistance fraud cases, also known as Administrative Disqualification Hearings, for the Food Stamp, Alaska Temporary Assistance, and Medicaid programs.

Emergency Medical Technician licensing cases, e.g., denial of an application to become an Emergency Medical Technician.

Child Care Assistance licensing cases, e.g., denial of an application to become an approved Child Care provider.

Assisted Living Home and Nursing Home licensing cases. (These hearings are shared with Office of Administrative Hearings located in the Department of Administration, depending on the specific licensing issue.)
- Criminal Registry cases as they relate to care providers.
- Medical Provider Audits.
- Hospital Medicaid Rate hearings.
